the following Terms and Conditions, "Hotmapping" means and includes all agents, employees,
sub-contractors, partners, the proprietor, owner and representatives
of Hotmapping.
WEBSITE
Nothing on this site shall be deemed to be an offer
by Hotmapping to provide any goods or services to
any person.
This site contains links to third party sites.
Hotmapping accepts no responsibility for the content
of those third party sites.
Although Hotmapping has made reasonable endeavours
to ensure that information contained on this site is
correct, it is possible that the information may be
incomplete, contain errors or be out of date.
GENERAL
Hotmapping will not be held liable in contract, tort
(including negligence) or otherwise for any loss or
damage which may arise from access to or any use of
the information and material contained on this site
or any site that may be accessed through this site.

The laws of the United Kingdom shall apply to these
Terms of Use. Any disputes arising out of these
Terms of Use shall be subject to the exclusive
jurisdiction of UK courts.
ORDER ACCEPTANCE
All contracts of sale made by Hotmapping shall he
deemed to incorporate these terms and conditions
(which shall prevail over any other document or
communication from the party with whom Hotmapping is
dealing (The Customer).
All orders are accepted and fulfilled subject to
these conditions of sale unless otherwise varied by
agreement in writing by Hotmapping.
DATA SETS AND SURVEYS
Every effort is made to achieve full coverage of
the survey areas however Hotmapping reserves the
right to limit surveys of locations where, in the
opinion of the survey engineer, access to a vantage
point may be hazardous or where entry is restricted.
Where access has been restricted by a third party,
or where hazards beyond the control of Hotmapping
exist then we reserve the right to invoice at the
full, specified rate regardless of omitted areas.
We do not guarantee 100% ground coverage with aerial
survey data due to the nature of collection.
Standard sorties include a swathe overlap to ensure
reasonable area coverage but there may be times when
the overlap is insufficient or the data collected is
unusable, possibly due to weather, air traffic
control or other causes. These types of situations
are totally out of our control and Hotmapping will
not accept responsibility for lost, missing or
affected data. In these circumstances Hotmapping
reserve the right to invoice at the full, specified
rate regardless of omitted areas.
Great care and attention is given to choosing an
appropriate time to carry out surveys, however we
can only collect data that is recorded under the
conditions dictated by the environment. Physical
constraints must therefore be understood and
accepted by the customer.
INDEMNIFICATION
By using our services, products or data you agree that you will
defend, indemnify, save and hold Hotmapping
harmless and free from any and all demands, liabilities,
losses, actions, costs and claims, including legal costs and
fees asserted against Hotmapping, its agents,
its customers, officers, owners, proprietor and
employees, that may arise or result from any service
provided or performed or agreed to be performed or
any product or data provided or sold by Hotmapping.
You agree to defend, indemnify and hold harmless and
free of any liability Hotmapping against liabilities arising out of
(1) any injury to person or properties caused by any
products or services sold or otherwise distributed
in connection with Hotmapping's services or products; (2) any material supplied by customers
infringing or allegedly infringing on the
proprietary rights of a third party; (3) copyright
infringement; (4) defective, inaccurate or
substandard services or products; (5) loss
of business as a result of any service or product provided by
Hotmapping.
DISCLAIMER
Hotmapping will not be responsible for any
damages your business or organisation may suffer.
Hotmapping
makes no warranties of any kind, expressed or
implied for services and products we provide.
Hotmapping
disclaims any warranty or merchantability or fitness
for a particular purpose. Hotmapping reserves the right to revise its policies
at any time.
PAYMENT TERMS
Invoice payment is due 7 days from the invoice date.
Invoices will be presented in Sterling. Any
charges incurred remain the responsibility of the
customer.
Euro transactions will be treated as a foreign
currency. Invoices will be issued in Sterling;
conversion & transfer charges are the responsibility
of the customer.
If an invoice becomes overdue for payment the full
outstanding account becomes overdue and payable.
Hotmapping reserves the right to charge interest on
overdue amounts at 3% above bank base lending rate.
Hotmapping reserves the right to recover costs
associated with debt collection or recovery.
